Welcome to Shadowhearth Emporium. The terms “we,” “us,” and “our” refer to Shadowhearth Emporium — Michael Viklund (Enskild Firma). We operate this store and website, including all related information, content, tools, products, and services (collectively, the “Services”). Our store is powered by Shopify.
By visiting, interacting with, or purchasing from Shadowhearth Emporium, you agree to be bound by these Terms together with our Privacy Policy and Return & Refund Policy. If you do not agree, you must not use the Services.
1. Access & Account
You must be at least the age of majority in your country of residence to use the Services.
You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.
We are not liable for losses arising from unauthorized access, misuse, or failure to maintain account security.
2. Products & Marketplace Fulfillment
We strive to present our products accurately; however, colors, materials, and dimensions may vary slightly due to lighting, screen calibration, or supplier variation.
Many products are produced or fulfilled by third-party partners such as Printful or Spocket. While we coordinate fulfillment and quality checks, manufacturing, packaging, and shipping are handled by these partners.
3. Orders & Acceptance
Placing an order constitutes an offer to purchase. We may accept or decline any order at our discretion for reasons including product availability, pricing errors, or suspected fraud.
An order is accepted only when we send a confirmation email. We reserve the right to limit quantities or cancel duplicate or reseller orders.
4. Prices, Taxes & Billing
All prices are displayed in SEK and include Swedish VAT (25 %) unless otherwise stated.
Shipping, customs duties, brokerage fees, or import taxes may apply and remain the customer’s responsibility unless otherwise indicated at checkout.
By completing a purchase, you authorize us and our payment processors to charge your selected payment method for the total displayed amount.
We may request additional verification before accepting an order.
5. Shipping, Delivery & Risk of Loss
Orders are fulfilled and shipped by our third-party partners. Delivery times are estimates only and not guarantees.
We are not responsible for carrier delays, customs clearance, weather, or force majeure events.
Risk of loss and title pass to you once the order is handed to the carrier.
You are responsible for providing accurate delivery details. Parcels refused by customs or uncollected may be returned or destroyed; related costs remain your responsibility.
6. Returns & Refunds
All returns and refunds are governed by our Return & Refund Policy, which forms part of these Terms.
Returns must be pre-authorized and shipped to the supplier address provided. Unauthorized or direct returns to our business address cannot be processed.
7. Intellectual Property
All content, trademarks, graphics, logos, text, and images displayed through the Services are the exclusive property of Shadowhearth Emporium or its licensors and are protected under Swedish and EU copyright law.
You may not reproduce, distribute, or create derivative works without prior written permission.
8. Optional Tools & Third-Party Links
We may provide access to third-party tools “as is” and “as available.” Your use of these tools is at your own risk.
Our Services may contain links to external websites; we are not responsible for their content, security, or policies.
9. Relationship with Shopify
Shadowhearth Emporium is the seller of record for all transactions. Shopify provides hosting and payment infrastructure but is not responsible for fulfillment, refunds, or customer service matters.
10. Privacy
Personal data is collected and processed according to our Privacy Policy.
Shopify and other integrated partners also process certain data to complete transactions.
11. User Content & Feedback
If you submit reviews, ideas, or suggestions (“Feedback”), you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use and display such Feedback.
We may remove any unlawful or infringing content at our discretion.
You warrant that you own or control all rights to the submitted material.
12. Prohibited Uses
You agree not to use the Services to:
(a) violate any law or regulation;
(b) infringe intellectual-property rights;
(c) harass, defame, or harm others;
(d) upload viruses or malicious code;
(e) misrepresent your identity; or
(f) evade purchase restrictions.
We may suspend or terminate access for violations.
13. Export, Sanctions & Geographic Restrictions
You must comply with all applicable export and trade-control laws.
We may restrict access or shipping to jurisdictions or individuals subject to sanctions or embargoes.
14. Errors, Inaccuracies & Availability
Information on the Services may occasionally contain typographical or factual errors.
We reserve the right to correct such errors or update information at any time, including after an order has been submitted.
15. Chargebacks & Fraud Screening
We actively monitor for fraudulent transactions. Initiating a chargeback without contacting us first may result in evidence submission to your payment provider and account termination.
False or abusive chargebacks constitute civil fraud under Swedish law and may result in legal action.
16. Force Majeure
We are not liable for delay or failure in performance caused by circumstances beyond our control, including natural disasters, wars, labor disputes, epidemics, or telecommunications failures.
17. Disclaimer of Warranties
All products and Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose.
This disclaimer does not limit your mandatory consumer rights under Swedish or EU law.
18. Limitation of Liability
To the fullest extent permitted by law, Shadowhearth Emporium shall not be liable for indirect, incidental, or consequential damages, including lost profits or data.
Our total liability for direct damages shall not exceed the total amount you paid for the product giving rise to the claim.
Nothing in these Terms limits liability for gross negligence, fraud, or statutory consumer protections.
19. Indemnification
You agree to indemnify and hold harmless Shadowhearth Emporium, Shopify, and their affiliates, employees, and agents from any claims arising out of your breach of these Terms, your violation of law, or misuse of the Services.
20. Governing Law & Jurisdiction
These Terms are governed by the laws of Sweden.
EU consumers retain the protection of mandatory laws in their country of residence.
Subject to those protections, all disputes shall be resolved exclusively in the courts of Sweden.
21. Severability
If any provision of these Terms is held unenforceable, the remaining provisions shall continue in full effect.
22. Waiver, Entire Agreement & Assignment
Failure to enforce any right does not constitute a waiver.
These Terms, together with referenced policies, form the entire agreement between you and Shadowhearth Emporium.
You may not assign your rights without our written consent; we may assign ours without restriction.
23. Changes to Terms
We may update these Terms periodically. Revised versions take effect upon posting with an updated “Last Updated” date. Continued use of the Services constitutes acceptance of the revised Terms.
